Subject: Open Source Needs You to Act - Help Fight Proposed Patent Rules
To: <dave.taht@gmail.com>
Proposed USPTO proposed rules will make it harder to defend OSS against bad
patents in the hands of PAEs. Fight back by June 20th.

Hi Dave!
* Open Source Needs You to Act - *
Help Fight Proposed Patent Rules
*ISSUE*
The U.S. Patent and Trademark Office (USPTO) has issued a set of proposed
rules
<https://cfT5B04.na1.hubspotlinksstarter.com/Ctc/I2+113/cfT5B04/VVN7d58C75qbW2rDHF57vsP7zVhPn1w4_cKf1N65wGVh5knJZV3Zsc37CgPXMW62WJCb6ydvJtW3jylL55llyjhVY3PjB21W9RZW4TkVpR7cz_z2W6Cnnfs7L7gHCW8_wFkP6Jn49kW4D5fNX1GqM15W61CS3C4XsBs6W38tJ7y6k40_-W3Sm14N5fPkJ5W8bxpSK4MlZFGW6rHq8-205vQQW65D3482jyDzMW6cMzp54x-CBVW1qWdTn2PXjvNW5sw4gp5pZnccW5KmNs02C2lH7W3S-WSq7L8C07W8d4xPD2jGQb4W46dlDj79VD-hW4Q-z6J3FtykWW6YV2Mb3xCcpnW5DzW6W7JCXmsW4GSFl64nnHgnW50jd942hSWs8N9dDsvbHP8Q8W8tk8TX2ny-t_W2pcZy12DJTrVW1yt3-H1LkrdCW88P9zg3VCS7dW5JCNpz3kPWZDW47KwLd8LRdt1W13zK_x67VvP4W3MQGrC8F_Y_bN4rBYLJ27rHlW3mzxST2-8rR8W84S6Tv9cCmqyW6QDLqD9dPTps36yJ1>,
nearly all of which will make it harder to challenge poor-quality patents.
If implemented, these rules will make it harder to defend open source
software (OSS) against bad patents in the hands of patent trolls.
*BACKGROUND & IMPACT*
OIN & other open source supporters — IBM, Microsoft & The Linux Foundation
— funded Unified Patents’ Open Source Zone in 2019. Since then, this
program has challenged dozens of poor-quality, open-source related patents
with excellent success. The newly-proposed USPTO rules will negatively
affect the Open Source Zone’s ability to challenge patents, even though
many of the rules are apparently outside of the USPTO's authority
<https://cfT5B04.na1.hubspotlinksstarter.com/Ctc/I2+113/cfT5B04/VVN7d58C75qbW2rDHF57vsP7zVhPn1w4_cKf1N65wGTp5knJ3V3Zsc37CgTbLW4rwkT95P5114W7Fk50R6sXBj0W43dQ8V6fR3X6W9cwNjD1Wmp6mW1LnVhP2X7JXNN8p1y4N6w2CwN6sknN32WBRLW88fzK96xpBVKW1tZZ5f8Tkt2LW5jJKdj1VR3D9W353xnN95LnvvW6lzGc-1ybtrYW5MkNsT14svwJW7H5xmK5hLZ9FW8NHK4_7DW5_GW6mXX9964pCX8W7_BSkB6fyqGpW4jHLnB8rWT27VRp2wM27WmlxW2NwQ6Q99-D5vW2qBpg43YS3wLW2g-rZv39gCKfN889GZB_1s89W8bN0nN7Hp9d7Vh3S_18DGslLW8qwXhX6fXRhlW2QBJxq8zYFF7W80tQgH4B3PPcN3hJFWyFkTMtW1053Lp6dpfWFW6F_bHd15cs9CW1P-J256s9m433p1T1>
and plainly inconsistent with the intentions of the legislators that passed
the America Invents Act. They may also prevent organizations like OIN and
others from seeking patent reviews.
If these rules are enacted, patents that slipped through the system and
should have never been issued in the first place will:
- Be increasingly litigated against developers and users of OSS,
including businesses that rely on open source
- Raise the already high cost of patent litigation and cost
hundreds-of-millions of dollars, according to an economic impact study

- Impact all open source organizations worldwide that have a developer,
supplier or customer in the United States
- Make business more difficult in the United States, and slow innovation
globally
As it is critical to OSS that we help stop this proposal, The Linux
Foundation is hosting a free webinar entitled "Stopping Patent Trolls: Why
Open Source Urgently Needs Your Help, Now!", on June 7, 2023 10:30 AM PDT
(GMT - 7). To join the webinar and learn more, please register here
